1. Scope and Contract Partner
These General Terms and Conditions ("Terms") apply to all orders placed through this online shop between Paul Burmester, Bierkellerweg 20, 77876 Kappelrodeck, Germany ("we", "us") and the customer ("you"). They apply to consumers and business customers alike, unless a section expressly states otherwise. The language of the contract is English.
2. Conclusion of Contract
The presentation of products in the shop does not constitute a legally binding offer on our part, but an invitation for you to place an order. By completing the checkout process provided by the Shopify Buy Button system, you submit a binding offer to purchase. A contract is only concluded once we accept your order, which we do by sending you an order confirmation by e-mail.
3. Prices and Payment
All prices shown are total (final) prices per item. Sales are made under the German small business regulation (Kleinunternehmerregelung, § 19 UStG); accordingly, no value added tax is separately shown or charged. Shipping costs are calculated based on your delivery address and are displayed separately before you complete checkout — see our Shipping Policy for details. Accepted payment methods (e.g. credit card, PayPal, Apple Pay) are shown at checkout; payments are processed securely by Shopify and, where selected, PayPal.
4. Delivery
Delivery times and shipping destinations are set out in our Shipping Policy. We currently ship within Germany, to the rest of the European Union, and internationally; delivery times vary by destination. If an ordered item is unexpectedly unavailable, we will inform you without delay and, if you have already paid, refund any payment made.
5. Retention of Title
Delivered goods remain our property until payment has been received in full.
6. Right of Withdrawal
If you are a consumer, you have a statutory right to withdraw from your purchase. The details, exceptions and the withdrawal form are set out in full in our Right of Withdrawal & Returns page, which forms part of these Terms.
7. Statutory Warranty (Gewährleistung)
We are liable for defects in the goods we deliver in accordance with the statutory provisions on liability for defects (§§ 434 ff. of the German Civil Code, BGB). Consumers are entitled to the statutory warranty period, which is generally two years from delivery of the goods. This statutory warranty exists independently of, and in addition to, both the right of withdrawal (Section 6) and our voluntary handling of items damaged in transit described in our Shipping Policy. If goods you receive are defective, please contact us using the details in our Legal Notice so we can arrange a repair, replacement, price reduction or, where applicable, a refund in accordance with the statutory requirements. We do not offer a commercial guarantee (Garantie) over and above the statutory warranty at this time.
8. Liability
We are liable without limitation for damages resulting from injury to life, body or health caused by us, and for damages caused by intent or gross negligence. For damages caused by ordinary negligence, we are only liable if we have breached an essential contractual obligation (a "cardinal obligation", i.e. an obligation whose fulfilment is essential for the proper performance of the contract and on whose observance you may regularly rely), and in that case our liability is limited to the foreseeable, typically occurring damage. Liability under the German Product Liability Act (Produkthaftungsgesetz) remains unaffected.

10. Governing Law
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, this choice of law does not deprive you of the protection afforded by mandatory provisions of the law of the country in which you have your habitual residence, where those provisions grant you more extensive rights. Nothing in these Terms restricts your right as a consumer to bring proceedings before the courts of your own place of residence where mandatory law gives you that right.
11. Final Provisions
Should any provision of these Terms be or become invalid, this shall not affect the validity of the remaining provisions.
